Terms of Use — getdeal.am

This is the English version. If the English and Armenian versions differ, the Armenian version applies.

1. Who we are and how these Terms apply

getdeal.am ("getdeal", the "Service", "we") — who runs it:

getdeal.am is operated by a private individual (ֆիզիկական անձ) based in Yerevan, Republic of Armenia.
The operator's full name and postal address are provided on request by email and are included in every reply to a request about your data.

These Terms are a public offer under Articles 453–454 of the Civil Code of the Republic of Armenia. They are a standard-form ("adhesion") contract under Article 444 of the Civil Code: we set the terms, and you accept them by using the site. You accept these Terms when you open or use getdeal.am, and again, explicitly, when you tick the box while creating an account. If you do not agree, please do not use the Service.

These Terms are governed by the law of the Republic of Armenia. Nothing in them removes rights that Armenian law gives you as a consumer and that cannot be waived by contract.

2. Definitions

Shop — an online retailer operating in Armenia whose public product pages we read.
Offer — a product, its price and its availability as we observed them on a Shop's website at a given time.
Price checked at — the time shown next to an Offer, when we last read that price from the Shop.
Account — your registered profile on getdeal.
Our Content — everything we created ourselves: the design, code, text written by us, our product catalogue structure, product matching, price history and statistics.
Third-party Content — product names, descriptions, specifications, photographs, shop names, brand names and logos that originate from Shops or manufacturers.

3. What getdeal is, and what it is not

getdeal is an information service. We read publicly available product and price information from Shops, organise it, and show it side by side so that you can compare and find the lowest price.

getdeal is not a shop. We do not sell goods, we do not take orders, we do not process payments and we do not deliver anything. No sales contract is ever concluded on getdeal. getdeal is therefore not an "electronic trading platform" within the meaning of the Law "On Trade and Services" and the Law "On Protection of Consumer Rights"; those laws' rules on sellers and marketplaces apply to the Shop you buy from, not to us.

When you click "Go to store", you leave getdeal and continue on the Shop's own website. From that moment your purchase, payment, delivery, warranty and returns are governed exclusively by the Shop's terms and by Armenian consumer law as it applies to the Shop. We are not a party to that purchase and are not the Shop's agent.

getdeal is independent. We are not affiliated with, sponsored by or endorsed by any Shop or manufacturer. Shop names, brand names and logos are used only to tell you whose product and whose price you are looking at.

4. How we collect and rank information (transparency)

We believe you and the Shops should know how the data on getdeal is produced.

Source. All Offer data comes from pages that the Shops themselves publish openly on the internet for anyone to see, without a login. We do not access private or protected areas, we do not bypass access controls, and we do not use any Shop's customer data.
Method. Our software visits those pages at moderate intervals, typically once a day for prices, and reads factual information only: product name and identifiers, technical specifications, price, availability, warranty and instalment terms, and the link to the product page. We limit request rates so that our visits do not burden the Shops' servers, and we honour a Shop's technical or written request to stop (see Section 9).
Matching. We decide ourselves which listings from different Shops are the same product, using our own product model. Mistakes are possible; use the "Report a problem" button on any offer to tell us.
Ranking. By default, Offers for a product are ordered by price, lowest first, with in-stock offers before out-of-stock ones. Search results are ordered by how well they match your query. No Shop pays to influence the order of Offers. If we ever introduce paid placements or partnerships, we will label them clearly as "Sponsored" or "Partner" and explain any effect on ranking on this page.
Currency. All prices are shown in Armenian drams (AMD), exactly as published by the Shop, unless stated otherwise.

5. Accuracy of information; no warranty

We work hard to keep Offers accurate, but prices and stock change constantly and our data is a snapshot taken at the time shown as "Price checked at".

An Offer on getdeal is information, not a binding price offer. It does not oblige the Shop or us to sell at that price.
Before buying, always verify the price, availability and conditions on the Shop's website. The price on the Shop's site at the moment of purchase is the only price that counts.
We provide the Service "as is". To the extent Armenian law allows, we do not guarantee that Offers are complete, current or error-free, or that the Service is available without interruption.
We are not responsible for the content, quality, delivery, warranty or legality of goods sold by Shops, or for the Shops' websites.

If you spot a wrong price, a wrong product match or a dead link, please use "Report a problem". We review reports and correct data as quickly as we can.

6. Accounts

You must be at least 16 years old to create an Account.
Give accurate information and keep it up to date. One person, one Account.
Keep your password secret. You are responsible for activity under your Account until you tell us it has been compromised.
You may delete your Account at any time in Account → Privacy. Deleting the Account ends this agreement for you.
We may suspend or close an Account that breaks these Terms, abuses the reporting feature, attempts to disrupt the Service, or is used for unlawful purposes. Where reasonable we will warn you first.
Your personal data is handled as described in our Privacy Policy, which is part of these Terms.

7. Using the Service fairly

You may use getdeal for personal, non-commercial purposes: browsing, comparing, saving what you viewed, and reporting problems.

You may not:

copy, download or extract a substantial part of our catalogue, price history or other data, whether manually or with automated tools, or reuse it in another product or service. Our catalogue and price history are a database protected under Articles 58–61 of the Law "On Copyright and Related Rights". Occasional small extracts, quotations with a link to getdeal, and ordinary search-engine indexing are fine;
send automated requests at a rate that burdens the Service, bypass rate limits, or try to access non-public parts of the Service;
submit false reports, or reports containing insults, unlawful content or other people's personal data;
use the Service in a way that breaks Armenian law or these Terms.

8. Intellectual property

Our Content is owned by us and protected by Armenian copyright and database law. You may view it and share links to it. Any other use needs our written permission.

Third-party Content belongs to its owners. Shop names, brand names and logos are trademarks of their respective owners and are used descriptively, to identify the product and the seller, as permitted by Article 13 of the Law "On Trademarks". Product photographs and manufacturer descriptions are shown to identify the product, with a link to the source Shop. If you own rights in content shown on getdeal and want it removed or attributed differently, see Section 9.

9. For Shops and rights holders

We link to Shops and send them buyers; we want to work with you, not against you. If you represent a Shop or own rights in content shown on getdeal, you can ask us to:

Correct a price, product match, name or specification — send the offer link and the correct data;
Remove specific content, for example a photograph or description you own — send the link and proof of your rights;
Stop monitoring your website entirely, or exclude specific sections — send the request from an official address of the Shop (or set the standard robots.txt rules on your site; we honour them);
Partner with us — supply a product feed instead of being crawled, or discuss a referral arrangement.

Send requests to [email protected] with the subject "Shop request". We acknowledge within 2 working days and act on justified removal and opt-out requests within 5 working days. While a removal request is being reviewed, we may temporarily hide the content concerned. Opting out means your Offers disappear from getdeal; we cannot show your prices partially or selectively.

10. Links to other websites

getdeal contains links to Shops' websites and to our social media pages. We do not control those sites and are not responsible for their content, availability, terms or privacy practices. Opening a link is at your own discretion.

11. Paid features (reserved)

The Service is currently free of charge. If we introduce paid features (for example price alerts under a "Pro" plan), they will be described in a separate section of these Terms before you can buy them, with the price in Armenian drams including all taxes, the billing period, how to cancel, and your rights under the Law "On Protection of Consumer Rights". Nothing you use today will become chargeable without your explicit agreement.

12. Liability

The Service is provided free of charge and for information only. To the fullest extent permitted by Armenian law, we are not liable for any loss arising from a purchase decision you make based on information on getdeal, from inaccurate or outdated Offers, from the unavailability of the Service, or from the acts or omissions of Shops.
Nothing in these Terms limits or excludes liability that cannot be limited or excluded under Armenian law, including liability for intentional harm or harm to life or health, or your rights as a consumer under the Civil Code and the Law "On Protection of Consumer Rights".
You agree to compensate us for damage we suffer because you breach Section 7 (fair use).

13. Changes to these Terms

We may change these Terms when the Service or the law changes. The current version and its effective date are shown at the top of this page. Material changes that affect Account holders will be announced by email or by a notice in the account area at least 7 days before they take effect. If you keep using the Service after the effective date, the new Terms apply to you. If you disagree, stop using the Service and, if you wish, delete your Account.

14. Governing law and disputes

These Terms and any dispute connected with the Service are governed by the law of the Republic of Armenia. Disputes are resolved by the competent courts of the Republic of Armenia. Before going to court, please contact us at [email protected]; most issues can be solved quickly. Consumers keep any right to bring a claim before the court or authority provided by Armenian consumer protection law.

15. Language

These Terms are published in Armenian, English and Russian. The Armenian text is the legally binding version; the other languages are provided for convenience.
